Housing cooperative legal form is distinct from its tenure model, non-profit qualification and social-provider recognition. Ley27/1999 applies to cooperative activity across several autonomous communities unless mainly in one, and principally to Ceuta/Melilla (art2). A mainly single-community housing project normally follows that community’s cooperative law/registry; do not apply national minimums, capital or governance uniformly across Spain. ct-cooperativa-habitatges covers Catalan rules separately. National funding that admits housing cooperatives can include this Catalan statutory form; separately named housing/consumer integral categories are explained by ct-cooperativa-integral. Programme matching must preserve those regional identifiers rather than assuming they are one state-law entity.
Under state law, incorporation requires public deed and cooperative-register inscription for legal personality (art7); normally≥3first-degree members (art8), statutory minimum capital fully paid (art45), with no universal national euro minimum stated. State art89 allows property adjudication OR any lawful use/enjoyment title; retained cooperative ownership requires statutes governing member use/rights. State-law member debt exposure is normally subscribed capital, with specified post-exit liability up to returned contributions (art15); personal guarantees are separate.
Funding gates differ: es-national-cooperative-collaborative-housing requires protected collaborative use/rental commitments, while es-national-youth-rural-home is individual acquisition/self-build. es-legal-nonprofit-and-tax-status and es-national-social-housing-provider-recognition-2026 are additional tests; cooperative form is never German eG.
