Real Decreto-ley 26/2026, dated 29 September, published 30 September and effective 1 October 2026 (consolidated update 2 October), contains an enacted mandate to regulate affordable social housing provider recognition; it does not itself issue certificates to cooperatives. Additional provision 1 requires the Government, on MIVAU proposal, within six months to define and regulate certification/recognition of proveedores sociales de vivienda asequible, including cooperatives, using Housing Associations as a reference. Certification effects are expressly confined to participation in programmes and access to finance, tax advantages or procedural specialties at state level.
As checked 5 October 2026, this note verifies the statutory mandate, not a completed implementing regulation, available certification procedure, award or automatic fiscal benefit. Parliamentary convalidation and subsequent implementing rules need separate tracking; no final convalidation claim is made here. Article 9 of es-national-housing-plan-2026-2030 already allows social-provider classification under regional rules and qualifying collaboration agreements. These two routes must not be conflated.
A cooperative’s ordinary incorporation, non-profit status and recognition as a social housing provider are separate tests. Neither the national mandate nor a project describing itself as cohousing proves eligibility for a particular grant.
