A cooperativa d’habitatges under Catalonia’s Cooperative Act (Llei 12/2015, arts. 122–127) procures housing and associated services for members at cost; it may acquire/develop land, rehabilitate buildings, and deliver either ownership or full use (ple ús) to members. If it retains ownership, statutes must set member and cooperative use rights. This is the applicant legal form for Catalan cooperative housing projects, including projects using cessió d’ús; the tenure label itself is not a separate entity. The Act also permits public bodies, cooperatives and nonprofit entities needing premises to join. Ordinary housing cooperatives are not automatically nonprofit; see ct-cooperativa-sense-anim-lucre. An integral cooperative is a multi-activity subtype under article 136, rather than a distinct legal person; the 2026 HabitatgESS call expressly includes integral housing-and-consumer cooperatives that promote use-tenure housing. See ct-cooperativa-integral for this conditional route.

For constitution, Llei 12/2015 art. 12 and the Generalitat registration guidance require at least two members for a first-degree cooperative other than a consumer/user cooperative; within five years, it must add a third member of a statutory class (temporary members do not count for this purpose). The minimum share capital is €3,000, fully paid at formation (art. 70); member liability for cooperative debts is limited to subscribed capital (art. 69), subject to statutory and other member obligations. The official constitution sequence is name clearance, statutes, constituent assembly, public deed, tax ID, tax formalities and registration; the express procedure does not cover housing cooperatives. The published registration service states a maximum three-month registration decision once filed, but not the cost or full time to establish a housing cooperative; get current notary/tax advice. Housing cooperatives must allocate at least 2% of the total housing/local/complementary-building price (including land, urbanization, construction and general costs) to the statutory reserve and education/promotion funds; rehabilitation uses a 1% minimum on the works budget (art. 124). These are mandatory allocations, not a dedicated project-finance grant. Housing-cooperative governance and minimum continuity obligations continue after allocation; do not assume the society can be dissolved immediately after handover. For project finance, see ct-icf-habitatge-social-promocio and ct-generalitat-reserva-publica-solars. Household-level first-purchase support is separate: ct-icf-habitatge-emancipacio concerns purchase of a privately owned home, not cooperative shares.
