Under Catalan Civil Code (Book V, arts. 564-1 to 564-6), dret de superfície is a limited real right over another person’s land that temporarily separates ownership of a building from ownership of the soil. It must be constituted by public deed, which states the term (never more than 99 years under the Catalan rule), construction, any price/entry payment or ground rent, and related particulars. It may be registered in the Property Register. The deed can regulate transfers, consent, maintenance, expiry, and settlement. At expiry, the building normally reverts to the landowner without compensation unless the deed provides otherwise.
A public award’s term is project-specific. “75 years” is a common term in individual municipal awards, not a universal maximum for Catalonia; inspect the tender, award, and executed deed, including any extension option and its conditions. The surface holder (often a cooperative) owns the building during the right’s term; members’ rights arise separately from cooperative statutes and agreements. The expiry of the surface right can constrain those rights, so lifelong occupancy cannot be assumed. Other adjacent access models include ct-masoveria-urbana and ct-propietat-temporal-compartida. For current promoter finance, note that ICF distinguishes rent/cessió d’ús from surface-right tenure: ct-icf-habitatge-social-promocio. See also cessio-us-model.
