National framework; verify the territorial call AND land tender before applying. Articles 33–42 support new housing on public land through public/private partnership: derecho de superficie, concesión demanial, cesión en uso or analogous legal route. Eligible promoters include cooperatives, companies, foundations and public bodies (art. 35); cooperative identity alone does not win a municipal parcel. Minimum 50-year registered affordable/social rent or use tenure (art. 34).

Article 38 baseline ceiling €1,000/m², maximum 85 m² counted/home and 70% investment; advanced industrialisation or declared stressed market €1,100/m²/75%, both €1,200/m²/80%. Qualifying severe-dependency/disability assistive systems may add up to €8,000/home. Initial rent/use limit €9/m² plus prescribed annex allowances, with legal territorial adjustment/indexation. Resident incomes and requirements are set in the tender (art. 42). Architectural quality must carry at least 30% of tender scoring for programme assistance (art. 13).

The tender may include the grant payable by the territorial administration. Monitoring agreement, viable project and regional award remain necessary; land allocation and funding are distinct decisions.
