Every Soziale-Wohnraumförderung loan or grant comes with a Förderzusage that fixes (a) a Belegungsbindung — flats go only to holders of a Wohnberechtigungsschein (§ 27 WoFG; income ≤ €12,000 single / €18,000 two persons + €4,100 per further person
- €500 per child, § 9 WoFG, Länder deviate upward), (b) a höchstzulässige Miete (§ 28), and (c) a Bindungsdauer (§ 29). The Land may also hold Benennungs- or Besetzungsrechte (§ 26).
- Bindungsdauer by Land (as of the sources’ dates): NRW 25 or 30 yr (FRL öff Wohnen 2026); Hamburg 30 or 40 yr for Baugemeinschaften (IFB FöRi 2026), general ≥ 20; Hessen 15/20/25 yr tied to 20/30/40 % Finanzierungszuschuss (RL Miet 2026); RLP 25 or 30 (20 with higher income tier; ISB 2025); Saarland 20, +10 → 30 (SIKB 06/2026); Bavaria 25 / 40 / 55 yr by Förderstufe (35 yr for the 2026 Programm, BayVV 2330-B; bayern-wohnungsbauprogramm-mietwohnraum); Berlin 30 (berlin-ibb-wohnungsneubaufonds); Bremen 20 Regelfall for Bindungsankauf (RL 2026-08-27; bremen-wohnraumfoerderung and bremen-bindungsankauf flag an unpublished 40/60-yr Genossenschaftsprogramm as an open question); Niedersachsen 30/35; MV 20; Sachsen-Anhalt ≥ 20. Each figure is taken from the linked state note, which carries the primary Richtlinie URL; Niedersachsen, MV and Sachsen-Anhalt are 2022 values from Bundestag WD 7-3000-067/22 and are not re-verified today — treat them as an open question. Länder not listed: open question.
- Early repayment does not end the Bindung by default (§ 29 Abs. 1: Förderzusage must regulate it; NRW: “verkürzt nicht”; Hamburg: ends 10 years after repayment).
- Buy-out / Freistellung (§ 30): only by the Land, against Ersatzwohnungen or money, and only if public interest has lapsed — not a planning tool.
- Co-op lens: members must hold a WBS at move-in for bound flats; the eG must keep rents under the cap for the whole term (a Dauernutzungsvertrag does not escape § 28); Genossenschaftsanteile are allowed on top of rent (Hamburg caps them). Mixed projects put only the subsidised units under Bindung (Hamburg: up to 50 % free-financed). Owner-occupier WEG units are never Belegungs-bound — Eigentumsförderung binds Selbstnutzung instead.
