The owner-occupier ending of a Baugruppe: the land is split into Miteigentumsanteile each tied to Sondereigentum at one flat (§ 3 or § 8 WEG). Each household owns and finances its own unit; the WEG manages the common parts.

  • Founding: notarial Teilungserklärung with Aufteilungsplan and Abgeschlossenheitsbescheinigung (§ 8 WEG, by the GbR as sole owner) or a Teilungsvertrag among Miteigentümer (§ 3 WEG); Grundbuch creates one Wohnungsgrundbuch per unit. Notary/register fees scale with value (§ 311b BGB deed).
  • Governance: Gemeinschaftsordnung (§ 10 WEG) — binds successors only if recorded in the Grundbuch. A Veräußerungsbeschränkung (§ 12 WEG: sale needs consent, refusable only for wichtiger Grund) is the strongest anti-speculation tool available; price caps are not enforceable against Sondernachfolger.
  • Liability: each owner for their own loan; joint liability only for WEG debts in proportion to Miteigentumsanteile.
  • Exit: sell the unit at market (subject to § 12 consent). Capital gain is private — the opposite of the eG.
  • Tax: Grunderwerbsteuer per owner on land (and building if “einheitlicher Erwerbsgegenstand”, see grunderwerbsteuer-baugemeinschaft); no Körperschaftsteuer.
  • Banks: the most bankable form — standard Eigentumswohnung mortgage per household.
  • Money: per owner, not per group — kfw-124, kfw-300, kfw-308 and a state Eigenheim line; rental/social lines are closed to it. See Programme map.

Detail

Hamburg’s Agentur distinguishes “Baugemeinschaften im individuellen Eigentum” (GbR → WEG; households with sufficient income apply under the Förderrichtlinie Eigenheim) from “genossenschaftliches Eigentum” (Kleingenossenschaft, Kooperation, Mietergenossenschaft; Förderrichtlinie Baugemeinschaften). Mixed models exist: a WEG in which one unit-owner is an eG or e.V. holding the shared/rental flats.
