Konzeptvergabe (Konzeptausschreibung, Konzeptverfahren) is how a German municipality allocates its own land without an auction: the price is fixed in advance and bidders compete only on the quality of the Nutzungskonzept. It is the most important land instrument for co-ops and Baugemeinschaften, because a group can never outbid a developer on price but can outbid it on concept.

  • Mechanics: a council resolution sets Grundvoraussetzungen (rent tiers, social mix, ecology) and Auswahlkriterien; bids are scored on a published Bewertungsmatrix; the winner signs a Kauf- or Erbbaurechtsvertrag with covenants entered in the Grundbuch.
  • Legal basis: municipal self-government over municipal assets, against the Gemeindeordnung duty to realise the Verkehrswert. The accepted route is to price the covenants in — the below-market price is the consideration for bound rents and use obligations, usually wrapped in a städtebaulicher Vertrag (§ 11 BauGB) — and to keep below-market land to an undertaking inside EU state-aid limits by tendering openly.
  • Criteria that favour groups: long rent binding, self-administration, shared space, inclusion, ecology, Realisierungssicherheit — and in several cities tenders restricted to Genossenschaften and Mietshäuser-Syndikat projects.
  • Before applying: a legal form (or a signed pre-form), a financing concept, and two to three months per tender.

Open question (not a fact): whether haushaltsrechtliche Verkehrswert duties bar below-market Konzeptvergabe was not resolvable against a citable 2024 BGH decision on 2026-09-10. Treat Festpreis below Verkehrswert as council-resolution practice, not settled case law.
