A gemeinnützige Stiftung (2002, Hattingen) that takes land out of the market and leases it back to projects on Erbbaurecht. The point is not cheap money — it is removing the plot from the group’s balance sheet and from any future sale.
- The deal: the foundation buys or is given the land; the group buys or builds the building and holds it via Erbbaurecht. trias states it “beteiligt sich an der Finanzierung des Kaufpreises für den Boden” — which cuts the group’s equity need and its bank loan.
- Erbbauzins is negotiated, not tariffed: “Gemeinsam mit der Projektgruppe legen wir die Höhe und Staffelung des Erbbauzins für jedes neue Wohnprojekt individuell fest.” The foundation’s own explainer gives the market convention as 4–5 % of the Grundstückswert per year, with Staffelung and Wertsicherung possible. Erbbauzins income funds the foundation’s work and the next plot.
- Term: “meist zwischen 30 und 99 Jahren und ist frei vereinbar” — banks need a long enough term to lend against the Erbbaurecht, so aim high.

Detail
- Strings: the project’s goals are written into the Erbbaurechtsvertrag as a permanent Zweckbindung; breach can trigger Heimfall against a contractually fixed Entschädigung, “von Null bis zum vollen Verkehrswert”.
- Grants are small: “Zuwendungen bewegen sich von € 500 bis € 5.000, nur in Einzelfällen darüber”, and only to gemeinnützige bodies — trias states it cannot fund a Genossenschaft directly, but can fund a gemeinnützige entity inside the project (Kindergarten, Pflegeverein). Housing applications need a Finanzierungsplan and a Wirtschaftlichkeitsberechnung. Furnishing communal rooms is not funded.
- Giving a house to trias: owners transfer by Schenkung (optionally with Nießbrauch), Zustiftung or Verkauf; the foundation then passes it on in Erbbaurecht. This is the exit route for an ageing owner-project.
- Scale: over 1 million m² held, 54+ projects, 400+ Stifter*innen.
