A comunidad de propietarios under Ley49/1960 manages individually owned flats/units plus shared elements; it is not a cooperative-owned building or a capital company. Art3distinguishes private unit title and inseparable common-element share; art5constitutive title sets unit descriptions and quotas. Autonomous/foral civil-property regimes can alter the governing rules; verify local law.

Each unit owner bears property costs/obligations through quota and valid agreements (art9), with president representing the community (art13). Decision threshold depends on work/act (arts10,17); do not claim one universal majority or that every accessibility measure needs unanimity. Community creditors/owners have the liability regime in art22; it is not SL limited-liability membership.

es-national-building-rehabilitation expressly accepts communities/grouped communities and specified grouped owners; the community receives works aid but allocations must reflect cost and exclude legally ineligible owners. Member individual first-home/rehabilitation assistance is a different borrower/beneficiary route. A development group first acquiring land jointly does not automatically have a fully constituted homeowner community.
