A foundation is assets durably dedicated to general-interest aims, not a resident-member cooperative. Ley50/2002 arts2–3 govern non-profit/general-interest foundations within state competence; regional foundation regimes must be checked where relevant. Legal personality requires foundation-register inscription (art4), typically following a public deed; the Patronato governs (art14).
State-law endowment€30,000is presumed adequate, not a universal prohibitive minimum: smaller endowments require the first programme and economic viability justification. Monetary endowment may pay≥25%initially and balance≤5years (art12). Merely hoping to collect donations is not endowment. Land/endowment and incorporation/adviser costs are different.
Housing ownership/lease/public-land rights must serve the foundation’s aims and applicable oversight rules. es-national-social-housing-acquisition includes qualifying specialised non-profit foundations; other programmes still require protection, tenure and resident-income gates. Donation deductibility is not automatic from the word foundation: es-legal-nonprofit-and-tax-status explains separate Ley49/2002conditions.
Resident allocation, long-term building finance and exits need clear rights/contracts because residents do not acquire cooperative governance simply by occupying foundation-owned housing.
