An asociación is a separate non-profit membership entity, not a housing cooperative by another name. LO1/2002 art5 permits≥3natural/legal founders through public/private founding act and statutes; legal personality follows the founding act, while registration/publicity and pre-registration liability still matter (art10). No universal founding capital amount is prescribed by this formation rule.
Economic activity is possible, but benefits must serve the statutory aims and cannot be distributed to members/related persons (art13). Owning or operating housing still requires title, building permissions and programme eligibility; being non-profit does not alone supply protected-housing or social-provider status.
Declaración de utilidad pública is a separate qualification with art32conditions, including general-interest aims, activity not exclusively benefiting members, means, accountable governance and an established operational track record. Some housing acquisition/funding lines require this qualification or a specified social-economy/provider role; others use broader social/non-profit gates. Ley49/2002 donation tax privileges also require its own qualifying status/conditions.
Regional association law/registry competence and particular grant wording must be checked. An ordinary member-only resident association should not claim a public-benefit or cooperative-specific subsidy automatically.
